- Design Quotes
Design quotes are valid for a period of 45 days from the inital date of delivery of the quote. They are non-binding. On acceptance of a design quote, CLIENT recognizes that
Pricing is subject to change based on the full scope of the project. Blue Hollow Designs (herein referred to as BHD) will take all steps to keep CLIENT apprised of any changes in project scope and will not proceed with any additional work until a new price quote approved by CLIENT.
- Fees/Payment
Initial, non-refundable deposit of 25% is required before any work will begin on a project. The remainder of the fees are required before design is delivered to client unless previous arrangements are made. Exceptions to this term can be be found in Payment Plan. Acceptable forms of payment are cheque, Paypal or credit card through Paypal.
- Privacy
BHD takes the privacy of it's CLIENTS and it self very seriously. BHD will not release any information about the client to any third party. CLIENT agrees to provide BHD with any login information necessary to upload the design to their site.
- Copyright
Any content (including but not limited to text, images and scripts) provided to BHD for the purpose of design by the client will remain property of it's owner, whether that be the CLIENT or a third party. BHD assumes that all items given to BHD by the client for the purpose of design are legally obtained. CLIENT accepts all legal responsibility for the images submitted to BHD for the purpose of design . Please respect copyright law.
- Designer Branding/Linking
BHD reserves the right to place a link on CLIENT's website and all it's pages back to BHD.
- Website Hosting
CLIENT responsible for obtaining their own web hosting and domain name registration. Web design services do NOT include any webspace.
- Indemnification
CLIENT agrees that it shall defend, indemnify, save and hold Blue Hollow Designs harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorneys fees asserted against Blue Hollow Designs, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by CLIENT, its agents, employees or assigns.
CLIENT agrees to defend, indemnify and hold harmless Blue Hollow Designs against liabilities arising out of;
(a) any injury to person or property caused by any products sold or otherwise distributed in connection with Blue Hollow Design products
(b) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party
(c) copyright infringement
- Refusal of Service
BHD reserves the right to refuse or cancel a contract in the event that
CLIENT violates the conditions of the contract.
- User Conduct
BHD will not provide design services to any adult oriented sites (including but not limited to pornography), any sites promoting hate against any group or any site providing the illegal distribution of copyrighted items (both intellectual and actual).
- Third party modifications
BHD accepts no responsibility if any changes are made to original BHD designs by a third party.
- Pricing
All pricing is listed in Canadian dollars. CLIENT will be price quoted
in Canadian dollars. If CLIENT prefers invoicing in a different currency please specify so in the initial consultation.
- Design Changes
Minor design changes(less than one hour of work) may be made within
21 days of final design approval. Any changes requiring greater than one hour of work will be billed at an hourly rate of $25.00 per hour.
- Acceptance of agreement
This is a legally binding contract between the CLIENT and BHD. A copy of this contract will be electronically mailed to CLIENT to be signed and returned before any work on design is started. BHD strongly suggests printing a copy of this contract for your records.
